SALE OF COUNTERFEIT LUXURY GOODS GAINS PRISON TERM

In August 2006, Shanghai Pudong New District Administration for Industry and Commerce seized over 300 counterfeit goods infringing more than 10 registered trademarks including LV, PRADA and OMEGA from Fan, Renyao's premises. The total value involved was 2,394,030 yuan. Since the case is suspected to be a criminal case, it was handed over to police and prosecution authorities and brought to the court.

The court, after trial, held that LV, PRADA and OMEGA were trademarks registered at the Chinese Trademark Office and protected by law. Fan, Renyao tried to sell them with the knowledge that they were counterfeiting, which constituted the crime of selling with counterfeit registered trademark. Shanghai Pudong New District People's Court thus sentenced Fan, Renyao to 22 months in prison (with 30 months suspension of execution) plus 30,000 yuan in fines.
