China's
Court to Publicly List Verdict Enforcement Evaders
¡¡¡¡The Supreme People's Court of China
circulated in Beijing in July 2011 the latest developments
in fighting against verdict enforcement evaders and
published 9 representative cases in sanctioning the
evasion of legal enforcement locally. Deputy Chief Judge
of the Enforcement Board Mr. Zhang Genda told that local
courts were expected to set up credit platforms sharable
with authorities concerned, preferably to set up credit
databases of individuals and enterprises by collecting
information on non-performance of obligations, to crack
down on enforcement evasion.
¡¡¡¡The courts were encouraged to work
with local authorities to execute credit-based punishment,
such as news publication, expenditure capping, restrictions
on border exit, lower credit rating and non-entry into
market. Meanwhile, the courts shall attach no less importance
to criminal penalties, which are irreplaceable in counter-evasion.
For serious enforcement evasion, the courts will impose
on the evaders the criminal liabilities for crime of
refusal in enforcing verdict or ruling, or crime of
performing illegal disposition of sealed, seized and
frozen properties.
¡¡¡¡Civil judgment has long been suffering
low enforcement in China's judicial system. However,
along with the strengthening of enforcement, by the
end of this May, the courts nationwide enjoyed a rate
of 63.66% in completion of verdict enforcement, with
80.52% of enforcement in process, up 12.7% and 7.1%
over the same period last year.
